Welcome to VAMP.INDUSTRIES. Throughout the site, the terms "we", "us" and "our" refer to VAMP.INDUSTRIES (Proprietor: Vincent Schönborn). VAMP.INDUSTRIES operates this online store, including all related information, tools, products, and services provided to you, the customer (the "Services"). Our store is hosted on Shopify Inc., which provides us with the online e-commerce platform that allows us to sell our products to you.
By visiting our site and/or purchasing from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms"), including those additional terms and policies referenced herein or available via hyperlink. Please read these Terms carefully before accessing or using our website.
SECTION 1 - SCOPE & CONTRACTUAL PARTNER
1.1 These Terms of Service apply to all orders placed by consumers and businesses via our online store.
1.2 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities (§ 13 German Civil Code - BGB).

SECTION 2 - PRODUCTS & BESPOKE PRODUCTION (MADE TO ORDER)
2.1 We have made every effort to display the colors and images of our jewelry pieces as accurately as possible. Due to screen settings and individual display technologies, slight color variations may occur.
2.2 Made to Order / Handcrafting: Every ring is individually cast, serialized, hand-polished, and digitally refined upon order in our Berlin laboratory. Minor surface variations and microscopic nuances are characteristic features of unique handcrafted casting and do not constitute material defects, provided the quality meets customary standards.
2.3 All product descriptions and availability are subject to change at any time without notice at our sole discretion.
SECTION 3 - ORDER PROCESS & CONCLUSION OF CONTRACT
3.1 The presentation of products in our online store does not constitute a legally binding offer, but rather an invitation to place an order (invitatio ad offerendum).
3.2 By clicking the "Buy Now" / "Complete Order" (or equivalent) button during the checkout process, you place a binding purchase offer for the items in your shopping cart.
3.3 The contract is concluded when we accept your offer either by sending an express order confirmation/acceptance via email, by issuing an invoice, or by handing over the goods to our shipping carrier. The automated order confirmation immediately sent after placing the order merely documents the receipt of your order and does not automatically constitute contract acceptance unless explicitly stated otherwise.
3.4 If payment is processed immediately via an instant payment method (e.g., PayPal, credit card instant capture, Apple Pay, Klarna Instant), the contract is concluded at the moment payment is confirmed.
SECTION 4 - PRICES AND PAYMENT TERMS
4.1 All prices indicated in our online store are final prices in Euro (€) and include the applicable statutory value-added tax (VAT).
4.2 We offer free shipping for all deliveries within Germany.
4.3 The available payment methods are displayed during the checkout process. Payment is due immediately upon conclusion of the contract unless otherwise specified for specific payment methods.
4.4 You agree to provide current, complete, and accurate purchase and account information for all transactions made at our store.
SECTION 5 - RETENTION OF TITLE
The delivered goods remain the property of VAMP.INDUSTRIES until full payment has been received.
SECTION 6 - SHIPPING & DELIVERY
6.1 Delivery is available exclusively within Germany.
6.2 Since all products are manufactured upon order (Made to Order), the handling and production period comprises approximately 5–7 business days for laboratory production plus 1 business day for quality control and serialization (total handling time: approx. 6–8 business days).
6.3 Shipping is conducted via DHL (Insured Express/Standard Shipping). Carrier transit time is typically 1–2 business days. The total estimated delivery time from order to doorstep is approximately 7–10 business days.
6.4 Risk of Loss: For consumers, the statutory risk of accidental loss or deterioration of the goods during transit passes to you upon delivery of the goods to your designated shipping address or Packstation.
SECTION 7 - RIGHT OF REVOCATION (WIDERRUFSRECHT)
Consumers generally have a statutory 14-day right of revocation. Detailed instructions regarding the conditions, deadlines, and the model revocation form are provided separately in our Cancellation / Refund Policy.
SECTION 8 - STATUTORY WARRANTY & LIABILITY (GEWÄHRLEISTUNG & HAFTUNG)
8.1 Statutory Warranty: Consumers are entitled to the statutory warranty rights for defects in purchased goods pursuant to §§ 437 et seq. BGB.
8.2 Liability: VAMP.INDUSTRIES is liable without limitation for intent, gross negligence, culpable injury to life, body, or health, in cases of fraudulent concealment of defects, or under the German Product Liability Act (Produkthaftungsgesetz). In cases of slight negligence resulting in a breach of essential contractual obligations (cardinal duties), our liability is limited to foreseeable, contract-typical damages. Any further liability is excluded.
SECTION 9 - INTELLECTUAL PROPERTY
All designs, jewelry models, branding, logos, graphics, text, and digital refinery assets on the website and products are the intellectual property of VAMP.INDUSTRIES (Vincent Schönborn) or licensed third parties. Any unauthorized reproduction, distribution, modification, reverse engineering, or commercial use without prior written consent is strictly prohibited.
SECTION 10 - RELATIONSHIP WITH SHOPIFY
VAMP.INDUSTRIES is powered by Shopify Inc. Any contract of sale is concluded solely between the customer and VAMP.INDUSTRIES (Vincent Schönborn). Shopify provides the technical hosting infrastructure and is not a party to the sales agreement.

SECTION 12 - APPLICABLE LAW & DISPUTE RESOLUTION
12.1 Applicable Law: The laws of the Federal Republic of Germany shall govern these Terms of Service and all sales contracts, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as the protection granted by mandatory provisions of the law of the state of the consumer's habitual residence is not withdrawn.
12.2 Consumer Dispute Resolution: We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
SECTION 13 - SEVERABILITY CLAUSE
If any provision of these Terms of Service is deemed invalid, void, or unenforceable, the validity and enforceability of the remaining provisions shall not be affected. The invalid provision shall be replaced by statutory law.
